These Terms & Conditions (“Terms”) govern the use of the Hyroscale platform (“Service”), a brand owned and operated by Techbridge & Advisory Partners GmbH (“we,” “us,” “our”). By accessing or using Hyroscale, you (“User,” “you”) agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the platform.

2. Scope of the Service

Hyroscale is a cloud-based software platform designed to help B2B companies automate outbound sales processes using AI-supported workflows. The platform enables lead generation, personalized outreach, campaign analytics, and CRM integrations.

Access to specific features may depend on your subscription plan.

3. Eligibility

To use Hyroscale, you must:

• Be at least 18 years old
  
  
• Be authorized to enter into binding agreements on behalf of your company (if signing up as a business)
  
  
• Provide accurate and complete registration information
  
  

We reserve the right to suspend or terminate accounts that violate these conditions.

4. User Responsibilities

You agree to use the platform in compliance with applicable laws and these Terms. You must not:

• Misuse the platform for unlawful or harmful purposes
  
  
• Reverse-engineer, decompile, or copy parts of the software
  
  
• Attempt unauthorized access to system resources or data
  
  
• Use Hyroscale to send spam or violate data protection regulations (e.g., GDPR)
  
  

You are responsible for securing your account credentials and ensuring that your use of the platform does not breach local or international laws.

5. Subscription, Billing & Payment

Certain features require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees in accordance with your selected plan and/or offer
  
  
• Provide valid and up-to-date billing information
  
  
• Allow recurring billing if applicable
  
  

Unless otherwise agreed in writing, all fees are non-refundable. We may suspend access for late or failed payments.

6. Intellectual Property

All content, code, features, and branding of Hyroscale remain the intellectual property of Techbridge & Advisory Partners GmbH. You are granted a limited, non-exclusive, non-transferable license to use the platform during your subscription period.

You may not reuse, copy, or redistribute any part of the platform without our express written consent.

7. Data & Privacy

We take your privacy seriously. For full details on how we process and protect your personal data, please refer to our Privacy Policy.

You retain ownership of your uploaded data. By using Hyroscale, you grant us the right to process and analyze data as necessary to deliver the service.

8. Availability & Updates

We aim to provide uninterrupted access to Hyroscale but do not guarantee 100% uptime. We may update, modify, or temporarily suspend features for maintenance or improvement purposes.

We reserve the right to discontinue any part of the service with reasonable notice.

9. Limitation of Liability

To the extent permitted by law, Techbridge & Advisory Partners GmbH shall not be liable for:

• Indirect, incidental, or consequential damages
  
  
• Loss of profits, data, or business opportunities
  
  
• Service interruptions or technical failures
  
  

Our total liability under these Terms shall not exceed the amount paid by you in the preceding 3 months.

10. Termination

We may terminate or suspend your access to the platform at any time, with or without notice, if you violate these Terms or misuse the service.

You may terminate your account at any time by providing written notice. Termination does not relieve you of your obligation to pay outstanding fees.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hamburg, Germany.

12. Changes to These Terms

We may update these Terms from time to time. You will be notified of any material changes. Continued use of the platform after such changes constitutes acceptance of the revised Terms.
